Terms of Service for Brands

1. Acceptance of Terms

By accessing or using the Instoly Brands portal (instoly.com/brands), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use our service. These terms apply specifically to brand and advertiser accounts on Instoly.

2. Description of Service

Instoly Brands is a creator discovery and partnership platform that helps brands find, evaluate, and connect with Instagram creators. The service includes:

  • Creator Discovery: Search and filter Instagram creators by niche, audience demographics, follower count, and engagement metrics using Meta's Creator Marketplace API
  • AI-Powered Analysis: Creator-brand compatibility scoring, audience fit analysis, and content evaluation powered by Google Gemini AI
  • Shortlists and Comparison: Save, organize, and compare creators side-by-side
  • Campaign Brief Generation: AI-assisted campaign brief creation and outreach suggestions
  • Partnership Messaging: Communicate with creators directly through the platform
  • Analytics: Track creator performance and audience insights

3. Account Responsibilities

  • You must be an authorized representative of a legitimate business or brand
  • You must connect a valid Instagram Business Account to use creator discovery features
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must not share account access with unauthorized individuals
  • You are responsible for all activity that occurs under your account
  • You must provide accurate and current business information

4. Acceptable Use

You agree not to use Instoly Brands to:

  • Send spam, unsolicited bulk messages, or misleading outreach to creators
  • Violate Instagram's Terms of Use or Community Guidelines
  • Exceed or attempt to circumvent Meta's API rate limits
  • Harass, pressure, or send threatening messages to creators
  • Scrape, copy, or redistribute creator data obtained through the platform
  • Use creator data for purposes beyond those permitted by Meta's Platform Terms
  • Impersonate another brand, person, or entity
  • Promote illegal activities, prohibited goods, or restricted content

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. AI Features Disclaimer

Instoly uses Google Gemini AI to provide creator recommendations, compatibility scores, and content analysis. Important things to know:

  • AI-generated scores and recommendations are estimates, not guarantees of creator performance or partnership success
  • Compatibility scores are based on available data at the time of analysis and may change as creator profiles evolve
  • AI-generated campaign briefs and suggestions are starting points — you should review and customize them before use
  • We do not guarantee the accuracy, completeness, or timeliness of AI-generated insights
  • Final partnership decisions are your responsibility — Instoly provides tools, not guarantees

6. Meta Platform Compliance

Instoly operates within the boundaries of Meta's Platform Policies and the Creator Marketplace API Terms. By using our service, you agree to:

  • Use creator data only for the purpose of evaluating potential partnerships
  • Respect creator privacy and not misuse their audience data
  • Comply with all applicable Meta policies regarding data use and messaging

7. Intellectual Property

The Instoly platform, including its design, code, AI models, scoring algorithms, logos, and content, is owned by Instoly (ISTPL) and protected by intellectual property laws. You retain ownership of any content you create using our service (campaign briefs, outreach messages, shortlist configurations).

8. Limitation of Liability

Instoly Brands is provided "as is" without warranty of any kind. We are not liable for:

  • Interruptions or changes to Meta's APIs or Creator Marketplace availability
  • Inaccuracies in creator data provided by Meta's APIs
  • AI recommendation accuracy or partnership outcomes
  • Loss of business opportunities arising from service interruptions
  • Changes to Meta's or Instagram's platform policies that affect service functionality
  • Creator responsiveness or willingness to engage in partnerships

9. Termination

You may close your brand account at any time by contacting support. We may terminate or suspend your account if you violate these terms or engage in behaviour that harms creators, the platform, or other users. Upon termination, we will delete your data in accordance with our Brand Privacy Policy.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or through a notice on the platform. Continued use of the service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in India.
